Introduction
Cypress Communications has created this privacy statement in order to demonstrate Cypress Communications’ firm commitment to privacy. Due to the sensitive nature of the information Cypress Communications collects from its Customers, Cypress Communications believes it is important to satisfy strict privacy requirements. The following discloses Cypress Communications’ information gathering and dissemination practices for the Web site:
 
Use
The Web site collects data through a feedback form that allows users to request information about Cypress Communications and its products and services. For this purpose, Cypress Communications requests and collects Customer’s contact information, consisting of name, address, phone number and e-mail address. The form also allows a Customer user to provide such other information, as he or she may desire to provide. Information so collected is used solely for the purpose of responding to the request of the Customer. Such request may include provision of Cypress Communications’ news alerts and other information about Cypress Communications and if so, the Customer’s contact information will be used for mailings of such information by Cypress Communications.
 
The Web site also provides a capability for Customers to submit their resumes to Cypress Communications via e-mail. Any resume so received by Cypress Communications will be held in confidence and used only for the purpose of considering the submitting party for employment or such other purpose as requested by the submitting party. Such information is not shared with third parties (other than contractors retained by Cypress Communications to assist in its hiring process) unless specifically requested or authorized by the submitting party.
 
Cypress Communications may use Customer IP addresses to help diagnose problems with its server, to administer the Web site, to analyze trends, to track Customer movement and use, and to gather broad demographic information. Such data is not linked to any personally identifiable information.
 
Cypress Communications may also use the information it collects from Customer to optimize its Web site so that it is more beneficial to users. This Web site contains links to other Web sites. Cypress Communications is not responsible for the privacy practices or the content of such Web sites.
 
Use of the site does not require registration and Cypress Communications does not use cookies.
 
Exceptions
Except as described above and as described in Cypress Communications’ Change of Control section below, Cypress Communications will not otherwise use or disclose any of Customer’s personal information, except to the extent reasonably necessary to: (i) correct technical problems and malfunctions in how Cypress Communications provides its service to Customer and to technically process Customer’s information; (ii) protect the security and integrity of the Web site and Cypress Communications’ service, including without limitation, to enforce Cypress Communications’ Terms and Conditions with Customer; (iii) protect Cypress Communications’ rights and property and the rights and property of others; (iv) take precautions against liability; (v) respond to claims that Customer’s information violates the rights and interests of third parties; (vi) the extent required by law or to respond to judicial process or both; and (vii) the extent permitted under other provisions of law, to provide personal information to law enforcement agencies or for an investigation on a matter related to public safety.
 
Customer understands and agrees that technical processing of Customer’s information is and may be required (a) to send and receive messages regarding Customer’s use of the Web site; (b) to conform to the technical requirements of connecting networks; (c) to conform to the limitations of Cypress Communications’ service; or (d) to conform to other, similar technical requirements.
 
Correct/Update
Customer may change or modify information previously provided to the Web site through e-mail to support@cypresscom.net.
 
Security
The Web site has security measures in place to protect the loss, misuse and alternation of the information under Cypress Communications’ control. Access to such information is limited to those required to fulfill the applicable Customer request.
 
Change in Control
If Cypress Communications experiences a "change in control" (defined below), Cypress Communications may amend its information practices as described in this privacy statement. Cypress Communications will post on its Web site’s home page a notice or a link to a notice which will describe how Cypress Communications will amend its privacy statement. If Customer does not agree to Cypress Communications’ amended privacy statement, Customer may contact Cypress Communications as described in this privacy statement, and Cypress Communications will allow Customer to opt out of the proposed amendment to its privacy statement with respect to the information that Cypress Communications has previously collected from Customer.
 
"Change in control," means any of the following events:
 
-Cypress Communications undergoes a reorganization, merger, consolidation, acquisition or other restructuring involving all or substantially all of Cypress Communications’ voting securities and/or assets, by operation of law or otherwise:
 
-Cypress Communications becomes insolvent;
 
-Cypress Communications makes a general assignment for the benefit of creditors;
 
-Cypress Communications suffers or permits an appointment of a receiver for its business or assets;
 
-Cypress Communications becomes subject to any proceedings under any bankruptcy or insolvency law, whether domestic or foreign; or
 
-Cypress Communications is liquidated, voluntarily or otherwise.
 
Notification of Changes
If Cypress Communications decides to change its privacy statement, Cypress Communications will post notice of those changes on its Web site’s home page so Customer is always aware of what information Cypress Communications collects, uses and discloses. Please regularly check the Web site for information about revision to this privacy statement. In the event Cypress Communications changes its privacy statement, such changes will affect all of the information Cypress Communications has previously collected from Customer, as well as the information Cypress Communications collects after any such change.
